These Terms of Service apply to all business relationships between Flowstate Automations (sole proprietorship) and the customer. Deviating terms of the customer are not recognized unless Flowstate Automations expressly agrees to their validity in writing.
Flowstate Automations offers AI-based automation solutions for sales and lead generation, including:
The exact scope of services is determined by the respective offer or order confirmation.
The contract is concluded upon written or electronic order confirmation by Flowstate Automations. The offer on the website does not constitute a binding offer, but an invitation to make an offer.
All prices are net prices plus statutory VAT. A one-time setup fee and a monthly management fee apply. The exact amounts are determined by the selected service package:
Invoices are due within 14 days of invoice date. Payment plans available: 50% upfront, 50% after 30 days, or 3 monthly payments of €4,500 for the Full Stack.
The customer receives a 90-Day ROI Guarantee for the Full Outbound Stack. If we don't deliver at least 6 qualified meetings in 90 days, we continue working for free until you do. No additional fees apply.
Setup fees are one-time payments. Monthly management fees run indefinitely and can be canceled monthly at the end of the month. Termination must be in text form (email is sufficient). Upon termination, the established systems and infrastructure remain with the customer.
The customer shall provide Flowstate Automations with all information required for setup in a timely manner, including:
Flowstate Automations is liable without limitation for intent and gross negligence. For slight negligence, Flowstate Automations is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damage. Flowstate Automations assumes no liability for revenue increases, lost profits, or indirect damages.
For the processing of personal data, our Privacy Policy applies. Flowstate Automations processes customer data exclusively for contract fulfillment and in accordance with GDPR regulations. All systems are self-hosted on customer infrastructure.
Flowstate Automations ensures that all AI agents are legally identified as artificial intelligence. The customer is informed that the agents introduce themselves as digital assistants.
The law of the Federal Republic of Germany applies. Place of jurisdiction is Munich, as far as legally permissible. Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions shall remain unaffected.
